MMD 204E - Maritime Law

Course Objectives

The aim of this course is to enable students to follow the stages of legal reasoning in matters related to concepts and terminology specific to maritime law (law of the sea) and to develop their analytical skills in this field. In this context, the course aims to:
Ensure that students become aware of law of the sea concepts such as territorial waters, exclusive economic zones, continental shelves, straits, high seas, etc., in the legal relations of states over maritime areas
Ensure that students evaluate the disputes in the Aegean Sea and the Eastern Mediterranean, to which Turkey is a party, within the framework of the 1982 United Nations Convention on the Law of the Sea (UNCLOS)
To be knowledgeable about current law of the sea disputes
are targeted.
The aim of this course is also to enable students to express themselves regarding the fundamentals of maritime law concerning the responsibilities, obligations, and rights arising from the operation of merchant ships in maritime trade. In this context, the course aims to:
Teach maritime law and its concepts,
Protect and defend relevant rights and interests,
Acquire sufficient knowledge and skills to prevent potential legal disputes arising from ships and maritime operations.

The fundamental sources of Law of the Sea
The legal status of Maritime Areas
Internal Waters, Territorial Waters, Contiguous Zone, Fishing Zone, Exclusive Economic Zone, Continental Shelf, Straits, High Seas, International Seabed
The delimitation of Maritime Jurisdiction Areas
Practical Exercises / Case Studies I (Gulf Waters / Width and Outer Limits of Territorial Waters / Contiguous Zone / Jurisdiction of the Coastal State in Territorial Waters / Right of Innocent Passage / Right of Continuous Surveillance)
Introduction to Maritime Law.
Ship, registry, flag, seaworthiness and navigability.
Captain and crew.
Owner, ship operator, owner's rights and responsibilities.
Maritime trade contracts.
Practical Exercises / Case Studies II (Acquisition of Ship Status / Ship Ownership / Mortgage, Foreign Sales Contract and Delivery Methods / Bill of Lading, Carrier's Liability)
